By accessing or using the Westmont Elementary School Parent Teacher Organization ("PTO" or "we", "us", or "our") website at westmontpto.org ("the Site"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.
The Site is a website for the PTO, a registered 501(c)(3) nonprofit organization. It provides event information, volunteer signup and coordination, newsletters, meeting minutes, donation information, and general information about the PTO and its activities.
Public access: The Site is available to the general public for viewing event information, reading newsletters and meeting minutes, and accessing community resources.
Volunteer signup: Volunteer signup is intended for parents, guardians, school staff, and community members age 18 and older. By signing up to volunteer, you confirm that you are at least 18 years old.
Admin access: Admin accounts are created by invitation only and are not available through self-registration. Admin users are subject to these Terms and any additional responsibilities communicated during account setup.
The Site does not require user accounts for public access. Admin accounts are managed through a third-party authentication service (Clerk) and are created by invitation only.
You agree to use the Site in good faith and in accordance with these Terms. You agree not to:
Restrictions on volunteer contact information: PTO administrators who have access to volunteer contact information through the Site shall use that information solely for PTO event coordination purposes. Contacting volunteers for purposes unrelated to PTO activities is prohibited.
We reserve the right to suspend or terminate Site access for users for any reason including any violation of these Terms.
What you submit: When you sign up as a volunteer, you provide your name, email address, phone number, and your selected volunteer role(s). You may also commit to bringing supply or donation items for an event and may provide optional notes (for example, dietary needs or schedule information).
How we use it: Your information is used solely for coordinating the event you signed up for. PTO administrators may contact you about event logistics. See our Privacy Policy for full details on how your information is handled.
Your responsibility: You are responsible for the accuracy of the information you submit. If your availability changes, please contact the PTO so another volunteer can be arranged.
Consent to communications: By signing up as a volunteer, you consent to receiving event-related communications from PTO administrators about the specific event(s) you signed up for. These communications are limited to event coordination and logistics.
If you subscribe to our newsletter, we collect your email address and use it to send PTO updates. Newsletter subscription is optional and separate from volunteer signup. You can unsubscribe at any time using the unsubscribe link included in newsletter emails. Our newsletter is delivered through MailerLite; see our Privacy Policy for details on how your email is handled.
The Site and its original content — including text, design, graphics, and code — are owned by the PTO or its licensors. The Site may contain links to third-party websites and services. We are not responsible for the content, terms, or practices of those third-party websites and services.
The PTO is a registered 501(c)(3) nonprofit organization. Donations may be tax-deductible to the extent allowed by law. Consult your tax advisor for details regarding your specific tax situation. The PTO does not provide tax receipts through this Site; please contact the PTO directly if you need a written acknowledgment for tax purposes.
Donations are made directly to the PTO through Venmo, a third-party payment service, accessed via a link from our donate page. We do not directly process, store, or handle payments through this Site — all payment activity occurs via Venmo on Venmo's platform under Venmo's terms and privacy practices. If you do not agree to Venmo's terms and privacy policy do not make any payments/donations via the Site through Venmo. The PTO is not responsible for Venmo's terms, privacy practices, or any issues arising from the Venmo platform. Verify the recipient before completing any transaction.
Refunds: All donations are final and non-refundable. If you believe a transaction was made in error, please contact the payment processor or the PTO directly.
Fraud prevention: The PTO will never ask for donations through direct messages such as text messages. If you receive a solicitation claiming to be from the PTO through any other channel, do not respond and please notify the PTO.
Geographic scope: This Site is operated by a Nebraska 501(c)(3) organization. Solicitation of donations through this Site is directed primarily to Nebraska residents.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you agree to the terms of our Privacy Policy.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Event details — including dates, times, locations, and volunteer needs — are provided for informational purposes. The PTO makes reasonable efforts to keep information current but cannot guarantee accuracy. Please verify details with event coordinators.
This Site is operated by volunteers. While we strive to maintain the Site, we cannot guarantee uninterrupted or error-free operation.
The PTO does not provide professional, legal, medical, tax, or financial advice through this Site or any other way.
To the maximum extent permitted by applicable law, the PTO and its volunteers, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Site, including but not limited to:
In no event shall our total liability exceed $100.
We are not responsible for transactions conducted through third-party payment services linked from this Site. You assume all risk associated with those transactions.
Signing up as a volunteer through this Site does not create an employment relationship, contract, or binding obligation between you and the PTO. Volunteering is at-will, and either party may discontinue the arrangement at any time. The PTO or its associated school or district may require a background check for certain volunteer activities, at the discretion of the PTO or such school or district. Signing up to volunteer via the Site does not guarantee your ability to serve as a volunteer.
You agree to indemnify and hold harmless the PTO and its affiliates, volunteers, employees, officers, and agents from any claims, damages, or expenses arising from or related to your violation of these Terms or your misuse of the Site.
We may update these Terms from time to time. When we do, the updated Terms will be posted on this page with an updated date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Site.
By you: You may stop using the Site at any time.
By us: We may suspend or terminate your access to the Site if you violate these Terms or if we discontinue the Site or for any other reason or for no reason.
After termination: Upon termination of access, your right to use the Site ceases. Data retention and deletion follow our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any legal action arising from or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Sarpy or Douglas County, Nebraska, and you consent to the personal jurisdiction of such courts.
If you have a dispute regarding the Site, please contact us first using the information in Section 21. We will make good faith efforts to resolve the matter amicably.
Given the volunteer and community nature of this organization, we encourage direct communication over formal legal proceedings.
Class action waiver: Any disputes arising from or related to these Terms or the Site shall be resolved on an individual basis. You agree not to bring or participate in any class, collective, or representative action against the PTO.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the PTO regarding your use of the Site.
